Waste Collection Bow Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Bow provides waste collection and related services to domestic and commercial customers within its service area. By making a booking, confirming a quotation, or allowing our team to carry out a collection, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any person, business, or organisation that requests or receives services from Waste Collection Bow.

Company, we, us or our means Waste Collection Bow, the provider of the waste collection services.

Services means any waste collection, removal, handling, transport, or related services supplied by the Company to the Customer.

Waste means any materials presented by the Customer for collection, including household waste, commercial waste, bulky items, and other discards, subject to applicable waste regulations.

Service Area means the areas in which Waste Collection Bow operates and is able to provide services, as communicated by us at the time of booking.

2. Scope of Services

The Company provides scheduled and one-off waste collection services for domestic and commercial Customers. The specific scope of work, including the type and estimated volume of Waste to be collected, the collection location, and the price, will be confirmed at the time of booking.

The Company reserves the right to refuse the collection of certain items or categories of Waste where it is unsafe, unlawful, or impractical to collect them, or where the Customer fails to comply with these Terms and Conditions or relevant waste regulations.

3. Booking Process

3.1 A booking is made when the Customer contacts the Company and requests Services, and the Company confirms availability and provides a price or quotation. Booking may be made by telephone, email, online form, or other communication channels accepted by the Company.

3.2 The Customer must provide accurate and complete information at the time of booking, including:

Full name and contact details.

Collection address within the service area.

Type, approximate quantity, and nature of Waste to be collected.

Any access restrictions, parking limitations, or special conditions at the collection location.

3.3 Any quotation given is based on the information provided by the Customer. If on arrival the actual volume, weight, or nature of the Waste differs significantly from that described at the time of booking, the Company may revise the price, adjust the Services, or refuse the collection if deemed unsafe or not compliant with waste regulations.

3.4 Bookings are subject to the availability of collection slots. The Company will use reasonable efforts to attend on the agreed date and within any specified time window, but times are approximate and not guaranteed unless explicitly stated in writing.

4. Access and Collection Requirements

4.1 The Customer must ensure that the collection location is safe and accessible for our staff and vehicles at the agreed time.

4.2 The Customer is responsible for providing clear instructions regarding the Waste to be collected and for ensuring that the Waste is ready for collection in accordance with any guidelines given by the Company, such as containment, separation, and labelling requirements.

4.3 If access is restricted or unsafe, or if the Waste is not as described, the Company may, at its discretion:

Charge a call-out or waiting fee.

Amend the price for the Services.

Cancel the collection and treat it as a late cancellation.

5. Payments and Charges

5.1 The Customer agrees to pay the charges for the Services as quoted or as otherwise agreed prior to or at the time of collection. All prices are stated in pounds sterling and may be subject to applicable taxes.

5.2 The Company may require payment in advance, a deposit, or card details to secure the booking. Any such requirement will be communicated at the time of booking.

5.3 Payment methods accepted by the Company may include card payment, bank transfer, or cash, as specified by the Company. The Customer must ensure that any card or account used for payment is authorised and valid.

5.4 For account Customers or commercial Customers with agreed credit terms, invoices must be paid in full by the due date stated on the invoice. The Company reserves the right to charge interest and reasonable recovery costs on overdue sums, in accordance with applicable legislation.

5.5 If, on arrival, the volume or type of Waste to be collected differs from that declared at the time of booking, the Company may revise the charge accordingly. Any price adjustment will be explained to the Customer before proceeding with the collection.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting the Company during normal business hours.

6.2 If the Customer cancels a booking with sufficient notice, as specified by the Company at the time of booking, no cancellation fee will normally be charged.

6.3 If the Customer cancels with short notice, fails to provide access at the agreed time, or is not present where attendance is required, the Company reserves the right to charge a cancellation fee or a call-out charge to cover costs incurred.

6.4 The Company may cancel or reschedule a booking where it is prevented from providing the Services due to reasons beyond its reasonable control, including severe weather, vehicle breakdown, staff illness, or compliance with legal obligations. In such cases, the Company will use reasonable efforts to inform the Customer and arrange an alternative collection time.

7. Customer Obligations and Warranties

7.1 The Customer warrants that:

The Waste presented for collection belongs to the Customer or that the Customer has the authority of the owner to request its removal.

The Waste does not include any prohibited items, such as hazardous materials, clinical waste, asbestos, or any substances that require special handling outside the scope of the Services agreed.

The description of the Waste given at the time of booking is accurate in relation to type, approximate volume, and any special characteristics.

7.2 The Customer must not include in the Waste any items that are explosive, toxic, unlawfully possessed, or otherwise prohibited by law, or any materials which the Customer knows or suspects could cause harm or pose an unreasonable risk to persons, property, or the environment.

7.3 The Customer must ensure that no personal or confidential data remains on any items presented for collection, such as paperwork, electronic devices, or storage media. The Company accepts no responsibility for the security or deletion of any data contained within items collected.

8. Waste Handling and Regulations

8.1 The Company will handle, transport, and dispose of Waste collected from Customers in accordance with applicable UK waste regulations and environmental legislation.

8.2 The Company will use licensed facilities and authorised processes to treat, recycle, recover, or dispose of Waste, as appropriate. The Customer acknowledges that the Company may choose the methods and facilities used, subject to legal and regulatory requirements.

8.3 Where applicable, and when requested by the Customer, the Company may provide documentation or confirmation relating to the handling of certain types of Waste, subject to additional charges if appropriate.

8.4 The Customer agrees to cooperate with any reasonable requests for information that the Company may need in order to comply with waste regulations, including the nature, origin, and composition of the Waste.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions shall exclude or limit the Companys liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

9.2 Subject to clause 9.1, the Companys total liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable for the specific Services giving rise to the claim.

9.3 The Company shall not be liable for:

Any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.

Any loss or damage arising from inaccurate, incomplete, or misleading information provided by the Customer.

Any loss or damage that could not reasonably have been foreseen at the time the contract for Services was formed.

9.4 The Customer is responsible for removing or protecting any items that could be damaged during normal access for collection, such as fragile fixtures, decorations, or flooring. The Company shall not be liable for reasonable wear and tear or for minor cosmetic damage that may occur while providing the Services, provided reasonable care has been taken.

9.5 If the Company is unable to carry out the Services in full due to factors beyond its reasonable control, including but not limited to limited access, traffic conditions, or compliance with legal obligations, its liability shall be limited to providing the Services at a rescheduled time or issuing a refund for any Services not provided, at its discretion.

10. Insurance

The Company maintains insurance cover appropriate to the nature of its Services, including public liability insurance. Details of such insurance can be provided upon reasonable request.

11. Complaints and Disputes

11.1 If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with the Company as soon as reasonably possible, providing full details and any supporting information.

11.2 The Company will investigate complaints in a fair and timely manner and will work with the Customer to seek an appropriate resolution.

11.3 If a dispute cannot be resolved directly, either party may pursue its rights through applicable legal channels.

12. Data Protection and Privacy

12.1 The Company may collect and process personal data about Customers for the purposes of providing Services, handling bookings, managing payments, and fulfilling legal obligations.

12.2 Personal data will be handled in accordance with applicable UK data protection laws. The Company will take reasonable steps to keep such data secure and to use it only for legitimate business purposes.

13. Changes to Terms and Conditions

13.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, regulations, business practices, or the nature of the Services provided.

13.2 The version of the Terms and Conditions that applies to a particular booking will normally be the version in force at the time the booking was made, unless a change is required by law or regulatory authority.

14. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by any court or competent authority, such provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking provided by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services. They supersede any prior understandings, representations, or agreements, whether written or oral.

16. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of Services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By confirming a booking or allowing a collection to proceed, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions for the provision of waste collection services.
